RESOLUTION 2023-03
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TROY, LATAH COUNTY, IDAHO,
RESCINDING THE RESTRICTIONS FOR OUTDOOR WATER USE IN RESOLUTION 2023-02 AND ADOPTING A SCHEDULE FOR OUTDOOR WATER USE FOR THE CITY OF TROY, AND RESTRICTING THE COMMERCIAL SALE OF BULK WATER.
BE IT RESOLVED BY THE MAYOR OF THE CITY OF TROY AS FOLLOWS:
WHEREAS, the Twin Creeks Well, which serves as the primary water source for the City, has been operating inadequately;and
WHEREAS, subsequent investigation has identified the malfunctioning of the pump as the main cause; and
WHEREAS, a new pump has been ordered to be promptly followed by installation; and
WHEREAS, in light of the forecasted hot temperatures and the need to continue monitoring the Twin Creeks Well until its repair is completed; and
WHEREAS, based upon the authority granted to the City by the City Council under Troy City Code 7-9-1, the Mayor deems it necessary to proclaim conservation measures on outdoor water usage and restrict the commercial sale of bulk water
NOW THEREFORE, IT IS HEREBY DETERMINED, ORDERED AND RESOLVED AS FOLLOWS:
1 - The restrictions prohibiting all outdoor water usage, including outdoor water play, watering lawns, and washing cars, have been rescinded.
2 - That additional and continuous conservation measures are necessary to help protect the City’s water supply at this time.
3 - That restrictions imposing the following mandatory conservation measures will now be in effect until rescinded:

Residents are to minimize all water usage; however, some outdoor watering, including watering of lawns,gardens, and washing of cars, is permitted between the hours of 8 PM and 8 AM on Mondays, Wednesdays, and Fridays.
4 - That bulk water sales for commercial purposes are still suspended until further notice.
5 - That after notification by mail and by verbal notification by either the Mayor or his representative, the penalty for violating the emergency restriction on outdoor water usage will be a misdemeanor and punishable by a fine not to exceed one thousand dollars ($1,000.00) in accordance with Troy City Code Section 7-9-2.
6 - This Resolution shall continue in full force and effect until such a time as the Mayor no longer deems such water restrictions necessary and the water shortage concerns are no longer critical.
